1- GENERAL TERMS AND CONDITIONS OF SALE APPLICATIONS

Any registration of a sample implies that the customer fully agrees to the conditions described in this document. 


2- SAMPLE RECEIPT AND SAMPLING 

The content and identification of samples is under the customer responsibility. Burgundia Œnologie Laboratory draws the attention on the importance of sampling and more particularly on the representativeness of the samples, their filling and their transport conditions, which can have an impact on the analyses. Burgundia Œnologie is responsible for the sample only after it was taken in charge by a staff member. 

The customer makes his analysis request on the labels provided by the laboratory, according to the type of sample: Maturity or Must (red labels), End of Alcoholic Fermentation (green labels) or Finished Wines (blue labels). Each sample must be accompanied by a correctly completed label: Name of the applicant, sample identification, analysis to be performed (by checking the box(es) of the requested analysis). 

If the client does not wish the analysis report to be issued under accreditation (routine analysis that may contain advice), he must tick the box « COFRAC ANALYSIS REPORT NO ». If he wishes an accredited report, he must tick the « COFRAC REPORT YES » box. If the boxes EXPORT (specify the country of export), COMPETITIONS (specify the competition) or AGREEMENT are checked, reports will be issued under accreditation, because they are official analyses.

 The customer is free to choose the parameters to be analyzed, but he can nevertheless, if he wishes it, be guided by the laboratory. Burgundia Œnologie Laboratory reserves the right to refuse a sample which would not respect the conditions required for a qualitative analysis. Any analysis that would be invalid due to poor quality of the sample remains due to the customer to Burgundia Œnologie Laboratory. 

The “Test” report delivered by the laboratory concern only the objects submitted for analysis by the applicant.  

 

3- ANALYSIS METHODS

When the customer does not specify the analysis method to be used, the laboratory chooses the most appropriate one. The methods of analysis that can be performed by the laboratory are available on the tariffication list, on the website or on request. The accredited parameters and analysis methods are available on the COFRAC website (www.cofrac.fr) under the accreditation number 1-1676. The methods are clearly mentioned on the report issued under accreditation. The uncertainties measures can be included in the report or can be provided on request. 


4- ANALYSIS RESULTS TRANSMISSION

Unless otherwise specified by the client, routine analysis reports (issued without accreditation) are sent by mail or by telephone if they are of an urgent nature. 

Official analysis reports, issued under accreditation are sent by post. At the client’s request, these reports can also be sent by mail, in the form of a scan, but only the original paper copy is valid. 

The analysis time can be consulted on the website (www.burgundia.fr). These delays are only given as an indication. The laboratory responsibility cannot be engaged in case of non-respect of the said delays. 


5- SUBCONTRACTING

Some analyses that cannot be performed at the laboratory BURGUNDIA OENOLOGIE can be subcontracted. In the case, the customer is informed of the subcontracting and must give his agreement via the form transmitted by the laboratory before the beginning of the analyses. The laboratory chooses the competent subcontractor(s) and remains responsible for the work performed. The results can be reported on a report under the heading of BURGUNDIA OENOLOGIE Laboratory, in which the subcontracting is clearly identified. If the customers wish, he can choose the subcontractor, who will then take the responsibility for work done. 


6- COFRAC ACCREDITATION

Burgundia Œnologie Laboratory is accredited by the COFRAC under the number 1-1676. In thus respects the requirements of the ISO/CEI 17025 international norm, and the application rules of COFRAC for its activities of wines and must analysis. As such, the Quality Manual describing the organization and functioning of the laboratory is available to customers. The laboratory is authorized to publish analysis reports with the COFRAC TESTING mark. However, the customers of the laboratory are not allowed to use this accreditation mark other than the full reproduction of the report issued. The client undertakes to use the analyses only for purposes for which they were established. In case of misuse, the laboratory will not be liable to the client or third parties for the consequences of the use of the analyses. 

In the case of a request on an unaccredited analysis report, the report is returned without the accreditation mark. According to GEN REF 11, it shall not be in conformity with the accreditation standard or covered by the international recognition agreements. It is strictly forbidden to use this type of analysis report when accreditation is mandatory, to display it and to pass it on to third parties.


7- CONFIDENTIALITY

Information concerning the client, as well as the one provided by the client (or provided by another source) is confidential. Each staff member has agrred in writing to maintain confidentiality. The laboratory will not divulge any information without the client’s approval, except for applicable legal requirements (DGCCRF…) and within the framework of the laboratory control (COFRAC evaluations, internal audits,…). 


8- IMPARTIALITY

Burgundia Œnologie Laboratory performs its services with complete impartiality. Each staff member, as well as the management, are committed to the etics code of the laboratory. In its quality management system, the laboratory implements actions to avoid risks related to a loss of impartiality. BURGUNDIA ŒNOLOGIE Laboratory is committed not to accept commercial, financial or any other kind of pressure. 


9- COMPLAINTS

Clients may submit their observations and complaints to the laboratory. The documented process fir handling complaints is available on request.


10- PROTECTION OF PERSONALS DATA

Burgundia Œnologie Laboratory is likely to collect some of the personal data of its clients and users of its website (name, first name, telephone number, address, e-mail,…) for the realization of its services. In accordance with the General Regulation on the Protection of Personal Data (RGPD), the client has the right to information, access, modification, opposition, deletion, limitation of processing and portability on personal data. To do so, he just has to send a request by mail at laboratoire@burgundia.fr. The laboratory keeps all the data collected as long as it is necessary to carry out its services and to answer to the legal obligations. All this information is strictly reserved for an internal use. By accepting the conditions of this document, the client consents to the collection and use of this data for the management of his request.


11- PRICING

Clients can establish an annual contract with Burgundia Œnologie Laboratory. When customers have not signed the contract, the billing is done at the end of each month, according to the current rate.
